  1. TERMS & CONDITIONS — MOLECULAR TRICHOLOGY ONLINE STORE

    1. DEFINITIONS

    Store / Seller – Trichopartner sp. z o.o., KRS: 0000906870, NIP: 5272961555, REGON: 389227831, registered at ul. Kolejowa 43/U25, 01-210 Warsaw, Poland.

    Customer – any natural person, legal person or organisational unit placing an order via the Store.

    Consumer – a natural person purchasing goods for purposes not related to business or professional activity.

    Business-Consumer – a natural person conducting business activity, making a purchase of a non-professional nature (entitled to consumer protection under EU law).

    Product – a movable item available in the Store.

    Distance Contract – a contract concluded between the Seller and the Customer without simultaneous physical presence of the parties, using means of electronic communication, within the meaning of the EU Consumer Rights Directive.

    Order – a Customer’s declaration of intent to conclude a sales contract, submitted via the Store’s website.


    2. GENERAL PROVISIONS

    1. The owner and operator of the online Store available at www.moleculartrichology.com is Trichopartner sp. z o.o., acting as the Seller.

    2. The Store enables the conclusion of distance sales contracts between the Seller and the Customer.

    4. The Store ships Products exclusively within the European Union, excluding Poland.

    5. All prices are listed in euros (EUR) and include VAT, unless stated otherwise.

    6. All Products offered in the Store are new, original, and free from physical and legal defects.

    7. Information presented on the Store’s website constitutes an invitation to submit an offer, not an offer within the meaning of civil law.


    3. PROCEDURE FOR CONCLUDING A DISTANCE SALES CONTRACT

    1. Orders are placed via the Store’s online order form, available 24/7.

    2. The Customer selects Products, adds them to the cart, chooses the delivery and payment method, and confirms the Order.

    3. Submitting an Order constitutes an offer to purchase Products from the Seller.

    4. The sales contract is concluded once the Seller sends an e-mail confirming acceptance of the Order.

    5. Clicking the “Buy and Pay” button constitutes an obligation to pay the full Order amount.


    4. PRICES AND PAYMENT METHODS

    1. All prices include VAT and do not include delivery costs, which are indicated during checkout.

    2. Available payment methods:

      • PayPal

      • PayNow

      • Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro

    3. The entity providing online payment services is mElements S.A., operating the PayNow payment system.

    4. Card payments are processed via certified payment operators in accordance with applicable security standards (PCI DSS).

    5. Payment by card is considered completed once it is authorised and confirmed by the payment operator.

    6. In the case of card payments, Order processing begins immediately after successful payment authorisation.

    7. Failure to complete payment within 48 hours may result in Order cancellation.


    5. ORDERS AND DELIVERY

    1. Orders are processed within up to 48 hours from the moment payment is registered (including card payments).

    2. Delivery is carried out exclusively within EU Member States (excluding Poland).

    3. Estimated delivery time and costs are displayed during checkout.

    4. The Seller bears responsibility for the Product until it is handed over to the Customer.

    5. Upon receipt of the shipment, the Customer should inspect the parcel and, in case of damage, prepare a damage report with the courier and notify the Seller immediately.


    6. RIGHT OF WITHDRAWAL FROM THE CONTRACT

    1. Consumers and Business-Consumers have the right to withdraw from the distance contract within 14 days, without stating any reason.

    2. The withdrawal period starts from the day the Customer or a third party designated by the Customer receives the Product.

    3. The withdrawal declaration should be sent:

      • by e-mail: sales@molecular.pl, or

      • by post to the Seller’s address.

    4. The Product must be returned within 14 days from the date of submitting the withdrawal declaration.

    5. The Customer bears the direct costs of returning the Product.

    6. The right of withdrawal does not apply in cases specified in Article 38 of the EU Consumer Rights Directive, including:

      • sealed products which were opened and cannot be returned for hygiene reasons (e.g. cosmetics),

      • used or damaged products,

      • customised or personalised goods.


    7. REFUNDS AND RETURN OF PAYMENTS

    1. In the event of withdrawal, the Seller shall refund all payments received from the Customer, including delivery costs (except additional costs resulting from a non-standard delivery method), within 14 days.

    2. Refunds are made using the same payment method used by the Customer, including refund to the payment card, unless expressly agreed otherwise.

    3. The Seller may withhold the refund until the returned Product is received or proof of return is provided.

    4. The Seller may reduce the refund amount if the Product’s value has diminished due to handling beyond what is necessary to verify its nature and characteristics.


    8. COMPLAINTS AND STATUTORY WARRANTY

    1. The Seller is liable to Consumers and Business-Consumers for lack of conformity of the Product in accordance with applicable EU and Polish law.

    2. Complaints may be submitted:

      • by e-mail: sales@molecular.pl, or

      • in writing to the Seller’s address.

    3. The complaint should include:

      • Customer’s contact details,

      • Order number,

      • description of the defect and the date it was discovered,

      • Customer’s request.

    4. The Seller will respond to the complaint within 14 days from receipt.

    5. In B2B transactions, statutory warranty liability is excluded unless mandatory provisions apply.


    9. USER ACCOUNT

    1. Customers may create an individual user account in the Store.

    2. The Customer is responsible for maintaining the confidentiality of login credentials.

    3. The Customer may request account deletion at any time.

    4. The Seller may suspend or delete an account that violates applicable law or these Terms.


    10. PERSONAL DATA PROTECTION (GDPR)

    1. The personal data controller is Trichopartner sp. z o.o.

    2. Personal data is processed for order fulfilment, account management, communication, and marketing purposes (with consent).

    3. Customers have the right to access, rectify, erase, restrict processing, and object to processing of personal data.

    4. Detailed rules are described in the Store’s Privacy Policy.


    11. FINAL PROVISIONS

    1. These Terms & Conditions are governed by Polish law and applicable EU consumer protection regulations.
